The parties to the case have been heard. The RNI which had been advised at the last hearing to call the parties for discussion has requested for an adjournment to finally settle the issue. The Respondent No.2, Shri  Sorathia is also not present and has prayed for an  adjournment. Having regard to the facts of the case and the fact that on the last date of hearing also the case had been adjourned at the request of Respondent No.2,

We feel that no further adjournment is called for more so as it clear from records that the lapse in the instant case was due to an oversight on the part of RNI. Therefore, the matter can now only be settled by allotting one title to each of the contending parties. Since the Respondent No. 2 before us had applied for and been publishing 'Amreli Ni Arsi' since 1986.(even though at some stage of allotment of title the name got translated into English and the Appellant later obtained the same title) We modify 'Amreli Ni Arsi' should stand allotted to Respondent No. 2 Shri Gordhandas J. Sorathia and 'Mirror of Amreli', Shri Mansukh Bhai G. Rawal. The RNI and SDM , Amreli may take consequential action accordingly.
