Particulars of Organization, Functions and Duties

 

2.1. Objective/purpose of the public authority.

 

 The Press Council of India is a statutory quasi-judicial authority created under an Act of Parliament namely the Press Council Act, 1978 for the purpose of preserving the freedom of the Press and of maintaining and improving the standards of newspapers and news agencies in India. In discharge of its functions it receives grant-in-aid by way of budgetary allocation from the Central Government after due appropriation under “Non-Plan Scheme” through the Ministry of Information and Broadcasting.  It also levies a fee on the prescribed graded scale on the papers registered in the country.  Its Annual Accounts are audited as per the procedures laid down by the CAG.  

 

2.2. Mission / Vision Statement of the public authority.

 

Our Vision

 

The twin objects of Press Council of India as embodied in Section 13 of the Act of 1978 are to

 

(i)                  preserve the freedom of the Press and

(ii)                to maintain and improve the standards of newspapers and news agencies in India.

(iii)      An Appellate Authority under section 8 (c) of the Press & Registration of Books Act 1867, grant redress to a person aggrieved by an order of a Magistrate refusing to authenticate a Declaration under Section 6 or cancelling an existing Declaration under Section 8-B of the said Act of 1867. (Refer at Annexure –I)

 

Our Mission

 

The mission of Press Council of India is to help newspapers and news agencies to maintain their independence; to build up a code of conduct of newspapers, news agencies and journalists in accordance with high professional standards, to ensure on the part of the newspapers, news agencies and journalists the maintenance of high standards of public taste and foster a due sense of both the rights and responsibilities; to keep under review any development likely to restrict the supply and dissemination of news of public interest and importance; to promote a proper functional relationship among all classes of persons engaged in the production or publication of newspapers or news agencies; and to concern itself with development such as concentration of or other aspects of ownership of newspapers and news agencies which may effect the independence of the press.

 

2.3. Brief history of the public authority and context of its formation.

 

            Press Council is a mechanism for the Press to regulate itself. The raison d’etre of its unique institution is rooted in the concept that in a democratic society the press needs at once to be free and responsible.

 

            If the Press is to function effectively as the watchdog of public interest, it must have a secure freedom of expression, unfettered and unhindered by any authority, organized bodies or individuals. But, this claim to press freedom has legitimacy only if it is exercised with a due sense of responsibility. The Press must, therefore, scrupulously adhere to accepted norms of journalistic ethics and maintain high standards of professional conduct.

 

            Where the norms are breached and freedom is defiled by unprofessional conduct, a way must exist to check and control it. But, control by Government or official authorities may prove destructive of  this freedom. There, the best way is to let the peers of the profession, assisted by a few discerning laymen to regulate it through a properly structured representative impartial machinery. Hence, the Press Council was formed.

 

            The Press Council of India was first constituted on 4th July 1966 as an autonomous, statutory , quasi-judicial body, with Shri Justice J R Mudholkar, then a sitting Judge of The Supreme Court, as Chairman. The Council set up under the Act of 1965 functioned till December 1975. During the Internal Emergency, the Act was repealed and the Council abolished w.e.f 1/1/1976.

 

            A fresh legislation providing for the establishment of the Council was enacted in 1978 and the institution was revived in the year 1979 with the very same object of preserving the freedom of the press and maintaining and improving the standards of Press in India. The present Council is a body corporate having perpetual succession. It consists of a Chairman and 28 other members. Of the 28 members, 13 represent the working journalists. Of whom 6 are to be editors of newspapers and remaining 7 are to be working journalists other than editors. 6 are to be from among persons who own or carry on business of management of newspapers. One is to be from among the persons who manage news agencies. Three  are to be persons having special knowledge or practical experience in respect of education and science, law and literature and culture. The remaining five are to be Members of Parliament : three from Lok Sabha and two from Rajya Sabha.

 

The terms of the Press Council are as follows:

 

  1. November 16, 1966 – November 15 1969; extended by an ordinance upto March 31, 1970; again extended by an ordinance upto September 30, 1970.
  2. October 1, 1970 – September 30, 1973; extended by an ordinance upto June 30, 1974; again extended upto December 31, 1974; further extended upto December 31,1975
  3. February 28 1979 to February 27,1982
  4. March 8.1982 to March 7,1985
  5. July 9, 1985 to July 8,1988
  6. September 28, 1988 to September 27,1991
  7. October 14,1991 to October 13, 1994
  8. January 25,1995 to January 24,1998
  9. March 28,1998 to March 27,2001
  10. May 22, 2001 to May 21,2004
  11. October 12,2004 to till date

 

 

 

 

2.4. Duties of the public authority.

 

               The twin objects of the Press Council of India as embodied in Section 13 of the Act of 1978 are to

(i)                  preserve the freedom of the Press and

(ii)                to maintain and improve the standards of newspapers and news agencies in India.

(iii)               An additional function assigned to it is that of an Appellate Authority under the Press & Registration of Books Act 1867,  to grant redress to a person aggrieved by an order of a Magistrate refusing to authenticate a Declaration under Section 6 or cancelling an existing Declaration under Section 8-B of the said Act of 1867.    Annexure -–I) The Press & Registration Appellate Board consists of Hon’ble Chairman and a member of the Press Council of India.

     In a case of public importance, touching its statutory responsibilities, suo-motu take cognizance and make on-the-spot inquiry.

 

         In discharge of the above it functions as an advisory as well as adjudicatory body with quasi-judicial authority.  For discharging its functions as a quasi-judicial authority, the Council is divided into two Inquiry Committees consisting of 14 members each.

 

2.5. Main activities/functions of the public authority.

·        Redress the complaints lodged by the general public, the newspaper and the journalists regarding violation of the norms of journalism or of the freedom of the press.

 

·        Either suo-motu or on a reference made to it by the Government, undertake studies and express opinion in regard to any bill, legislation, law or other matters touching the Press and convey opinion to the authorities or the persons concerned.

 

·       In a case of public importance, touching its statutory responsibilities, suo-motu take cognizance and make on-the- spot inquiry.

2.8. Expectation of the public authority from the public for enhancing its efficiency.

 

            The efficacy of case disposal by the Council is dependent on the responses of the parties arraigned before it. It thus expects timely reply to its communications. The Press Council seeks cooperation of the public from time to time, especially during on the spot inquiry conducted by it. Invitations are sent to various cross sections of the public for seminars, conferences, workshops. Written opinions are also sought wherever desired.

            On conclusion of the adjudicatory process it expects the parties to comply with the directions in letter and spirit and to follow its guidelines in their future conduct and action.

 

2.9 Arrangements and methods made for seeking public participation / contribution.

 

Public contribution through participation in its debates/ seminars on invitation. A Press release is issued by the Press Council before the meetings of Inquiry Committee stating that  the proceedings are open for the public. During Special Inquiry Committee meetings participation / contribution of the public  is sought, by informing them about the data, time and venue of the meetings by way of issue of press release.

 

 

2.10. Mechanism available for monitoring the service delivery and public grievance resolution.

 

1.The Secretary, nominated as Director of Grievances is Nodal Officer for the purpose of grievances referring of matters within the jurisdiction of the Council.

2. The Deputy Secretary (Admn.) nominated as Staff Grievances Officer reporting directly to the Secretary of the Council.

3. The members of public who desire to meet the Director of Grievances may do so on all Wednesdays between 4.00 p.m. and 5.00 p.m. in his/her office.

4. The members of staff who desire to meet the Staff Grievances Officer may do so on all Tuesdays between 4.00 p.m. and 5.00 p.m. in his office.

5. The members of public and the members of staff who desire to meet the Secretary of the Council with regard to their grievances may do so on every Wednesday of second week in a month between 3 p.m. to 4.p.m.

Powers and Duties of Officers and Employees

The powers rest with the Council. The Chairman being whole   time officer and highest functionary in the organisation takes a final view in all the matters pertaining to the organization. The employees are bound by the powers and duties as laid down by the rules and procedures of the Government of India, the Council as well as orders and directions of the Hon’ble Chairman.  Organisational chart indicating the duties of its officers and staff may be referred as at Annexure-II.

Procedure followed in Decision Making Process

 

9.1 What is the procedure followed to take a decision for various matters ? ( A reference to Secretariat Manual and Rule of Business Manual, and other rules/ regulations etc can be made)

 

    In quasi-judicial functions it follows the testified procedure It follows the norms set by Government of India for administrative and accounts matters. For other matters it follows the procedure enshrined in the Press Council Act, 1978 ( r/w Rules and Regulations framed there under) as amended from time to time.

   

           The principles evolved in previous  adjudications set out by the Council from time to time   are referred  to while discharging its functions.

 

9.2 What are the documented procedures / laid down procedures/ Defined Criteria /Rules to arrive at a particular decision for important matters ? What are different levels through which a decision process moves ?

 

            The Press Council Act 1978, Press Council (Procedure for Inquiry) Regulation, 1979 as amended in 2006 and norms of Journalistic Conduct are the aim reference for arriving at decisions.

 

9.3 What are the arrangements to communicate the decision to the public ?

 

            The decision of the Council are communicated to the public by way of issuance of press release, published in quarterly journal and put on the website.

 

 

 

9.4 Who are the officers at various levels whose opinions are sought for the process of decision making?

 

            The hierarchy of the decision making process is as follows. Section Officer-Under Secretary-Deputy Secretary-Secretary – Hon’ble Chairman-Inquiry Committee- Press Council.

18.1 Frequently Asked Questions and their Answers by Public

 

Question: The requirements to be fulfilled by a complainant while lodging a complaint against a newspaper, news agency, editor or a journalist.

 

Answer:

i)                    Furnish original clipping(s) of the impugned news item/article/editorial etc. (English translation ,if the matter is in any language other than English is essential for all the Council members who hail from all over the Country to appreciate the contents of the impugned material).

ii)                   Specify in what manner the publication/non-publication of the matter is objectionable.

iii)                 Write to the editor of the newspaper concerned regarding the matter published /not published in the newspaper etc. , which in your opinion is objectionable giving your rejoinder thereto with a request for its publication.

iv)                 Furnish a copy of the reply, if any, received from the newspaper and/or the rejoinder published.

v)                  Subscribe to a declaration in the prescribed format regarding non-pendency of the subject matter in any court of law.

Question: The obligatory fee payable to the Council by all the registered newspapers / news agencies as per the circulation / grade.

 

Answer: The levy of fee charged from the registered newspapers/periodicals/ news agencies as per PCI amendment Rules, 1988 for a sum of Rs 100/- to              Rs 7,500/-. For this purpose a circulation range of registered newspapers and periodicals shall be the latest circulation  as available  with the RNI and the criteria for classification  of news agencies shall be such as indicated  in the Report of Wage Board for Working Journalists. The range of circulation figures according to the periodicities of publication is as under :

 

(a) registered newspapers and periodicals with a circulation range above 1,50,000-

(i)    Rs. 7,500 per annum from each daily;
(ii)   Rs. 4,500 per annum from each bi-weekly/weekly;
(iii)  Rs. 3,500 per annum from each fortnightly/monthly;
(iv)  Rs. 2,250 per annum from all other categories;

(b) registered newspapers and periodicals with a circulation range of above 1,00,000 and upto 1,50,000-

(i)   Rs. 5,250 per annum from each daily;
(ii)  Rs. 3,000 per annum from each bi-weekly/weekly;
(iii) Rs. 2,250 per annum from each fortnightly/monthly;
(iv) Rs. 1,500 per annum from all other categories;

(c) registered newspapers and periodicals with a circulation range of above 50,000 and upto 1,00,000-

(i)   Rs. 3,750 per annum from each daily;
